It is important for you to be aware of the laws and policies concerning the use of copyrighted material, especially digital material 鈥� music, movies, software, etc. As part of our commitment to raise awareness on these and other issues concerning your online safety and as required by the Higher Education Opportunity Act of 2008, we want to remind you of a few things.

All users of the network, including the Internet, at 草榴社区 are required to abide by and comply with all state and federal laws governing copyrights and trademarks as well as other applicable state and federal laws and applicable University polices. The use of copyrighted material may require the permission of the copyright owner. The absence of a copyright notice or symbol on a work does not denote a lack of copyright. Copyrighted works can include, but are not limited to, text, graphics, music, and photographs. In addition, you are required to obtain written permission before you are allowed to use any UAHuntsville's copyrighted materials, trademarks, or logos for commercial or any other unofficial University purpose.

Digital Millennium Copyright Act (DMCA)

Distributing copyrighted materials without the owner's consent is against federal law. You may be familiar with Peer to Peer (P2P), DC++, FTP Servers, IRC/DCC transfers or Instant Messenger file transfer, but their use for downloading or sharing copyrighted material is illegal.

  • In general, anyone found liable for civil copyright infringement may be ordered to pay either actual damages or "statutory" damages affixed at not less than $750 and not more than $30,000 per infringed work.

UAHuntsville and the DMCA

To protect the university and its students, faculty and staff, UAHuntsville has adopted the following DMCA violation policy:

  • First DMCA Notification: Network access for the user is disabled. The user will receive a copy of the DMCA notification. Once the P2P software is removed, network access may be restored.
  • Second DMCA Notification: Network access for the user will be disabled for one week. The user will receive the copy of the DMCA notification and will receive a warning that subsequent violations will result in loss of network access for the entire semester. Student Judicial Affairs may decide additional penalties for the Code of Student Conduct violations. The user must take computer to the TAG desk to have P2P software removed.
  • Third DMCA Notification: Network access for the user will be disabled for the entire semester. The user will receive a copy of the DMCA notification. Student Judicial Affairs may decide additional penalties for Code of Student Conduct violations.
